At a time when the number of cases filed under the ADA is growing rapidly, Carparts has extended the statute's reach to a class of defendants who may have considered their potential liability to be slim. Since self-insured plans provide more than 40 percent of the health benefits that Americans receive, Carparts, the first appellate court decision on this subject, will impact ADA law substantially.
In Carparts, the 1st U.S. Circuit Court of Appeals gave "timely guidance" concerning the scope of the ADA. The court placed trustees, administrators and agents of self-insured plans on notice that most lawsuits alleging discrimination under the statute will not be turned away at the courthouse door.
